In consideration of the enrollment of the above-named student (the “Student”) by Mount Alvernia High School, Inc. (the “School”) for the 2023-2024 academic year, the undersigned responsible parent(s), legal guardian(s), and/or financially responsible individual(s) (“I”), jointly and severally, and intending to be legally bound, on my own behalf and on behalf of the Student, agree to all of the following terms and conditions. This Enrollment Contract (the “Contract”) is for the 2023-2024 academic year only, and is contingent upon the Student’s successful completion of the 2022-2023 academic year (whether at the School or elsewhere) in good academic, disciplinary, and financial standing, as determined by the School, in its sole discretion.

By signing this Contract, the Student and I commit ourselves to Mount Alvernia High School - its values, ideals, and philosophy. I understand that attending the School is a privilege that may be revoked at any time in the School’s discretion. By enrolling my daughter in the School, my daughter and I agree to comply with the School’s policies, rules, regulations, and standards of academic and social behavior as stated in the School’s Family Handbook (the “Handbook”). I understand that the Handbook sets forth general expectations regarding the Student’s enrollment in the School, but that the Handbook does not constitute a contract between me and the School or the Student and the School, and that the School may deviate from the guidelines and expectations set forth in the Handbook in its discretion as individual circumstances may warrant. I also understand that the School may establish policies and make decisions it finds to be not only in the best interest of my/our daughter, but also in the best interest of the whole student body.

By executing this Contract, I understand and agree that I will be obligated to pay the following tuition and fees for the full 2023-2024 academic year on or before the deadlines selected in my payment plan below:

Tuition: $22,500.00
Class Fee: $650.00

Seat Deposit: A non-refundable, non-transferable seat deposit (“Deposit”) of $750 is payable with this signed contract and will be credited against the 2023-2024 tuition. Seat Deposit: A non-refundable, non-transferable seat deposit (“Deposit”) of $750 is payable with this signed contract and will be credited against the 2023-2024 tuition. I understand that this Deposit will be forfeited if the Student does not attend the School, withdraws from the School, or is dismissed from the School.
Payment Plan Options(Required)
Select One
I understand that the School depends solely on tuition and fees for its operating costs, and that the expenses of the School do not diminish with the departure of the Student, whether via withdrawal, dismissal, or for any reason, voluntary or involuntary, either prior to, or during, the academic year. Therefore, I understand that by signing this Contract, I accept the obligation to pay tuition and fees as detailed above for the academic year 2023-2024 unconditionally.

I understand that I may withdraw the Student without penalty (except forfeiture of the Deposit) if the Head of School receives written notice of the Student’s withdrawal prior to August 1, 2023. If the Student separates from the School on or after August 1, 2023, whether due to withdrawal or dismissal for any reason, voluntary or involuntary, I understand that I will be obligated to pay the full annual tuition and fees as liquidated damages. I agree that the amount of liquidated damages is a reasonable estimate of the damages likely to be incurred by the School as a result of the Student’s separation from the School on or after August 1, 2023, and that the actual damages are difficult or impossible to ascertain at this time. In the event of the Student’s separation from the School on or after August 1, 2023, all unpaid tuition and fees will become due and payable in full within thirty (30) days of the date of separation.

Failure to make timely payments to the School may result in significant consequences. I agree that if payment of tuition and other fees is not made in accordance with this Contract, the School may refuse to admit my daughter to class, sit for exams, or attend School events/activities, and may take any other action that the School deems appropriate, as permitted by applicable law. Acceptance of late payments by the School does not constitute a waiver of any subsequent delinquency, default, or breach of this Contract, or be construed as a waiver of the total amounts owed to the School. No failure or delay on the part of the School to fully enforce any right, power, or remedy under this Contract or any other student’s enrollment contract shall be construed as a waiver or otherwise preclude the School from fully enforcing its rights at any time with respect to the Student or any other student. The School may take appropriate legal action to collect tuition and fees which are not paid when due. In such an event, I will be responsible for all costs of collection including, but not limited to, administrative costs, reasonable attorney fees and costs, and collection company fees.

The School believes that a positive and constructive relationship among the School, the Student, and the Student’s family is essential to fulfillment of the School’s educational mission and values. I understand and agree that if the School determines that the Student, or a family member or other individual associated with the Student, has engaged in any behavior (whether on or off campus, and whether during the academic year or otherwise) that makes such a positive and constructive relationship difficult or impossible, runs contrary to the best interests of the School or members of the school community, or otherwise interferes with the School’s ability to fulfill its educational purposes, the School may suspend, dismiss, or refuse to re-enroll the Student or place restrictions on the Student’s, family member’s, or other individual’s involvement with School activities or events or presence on School property.

The School expects parents to cooperate in the Student’s best interests with respect to the Student’s education, including avoiding being disruptive to the Student’s education. Parents must provide details of any living and custody arrangements involving the Student to the School and keep Mount Alvernia High School’s Administrative Office apprised of any changes. In the event of divorce or separation, the School will provide both parents, regardless of custody status, equal access to any and all educational, administrative, social, and/or health information concerning the Student as well as all School announcements and related information. Moreover, each parent is granted access to the Student, teachers, and administrators and to attend School functions, subject to the School’s ordinary right to restrict access to School grounds. Such access is provided without notification to other parties and regardless of the party or parties named who claim financial responsibility. Exceptions to this policy are undertaken when necessary to comply with applicable law or when so ordered in writing by a court.

I understand and acknowledge that though the School endeavors to provide exceptional academic programs and assistance to students in helping them to achieve their academic goals and advancement, the Student’s success cannot be guaranteed by the School. I further understand and acknowledge that in its literature and in conversations with teachers and administrators, the School strives to describe its approach to education, but the School makes no representations or undertakings as to the kind, quality, or appropriateness of its education for the particular Student. The School may change, without notice, its curriculum, programming, and activities, as well as policies, procedures, and practices, as circumstances warrant. This includes, but is not limited to, providing alternate means of instruction, such as distance learning. The School will endeavor to provide prompt notice of any such changes.

I agree it is in the best interest of the Student for the School to be fully aware of the Student’s medical, disciplinary, and emotional health history, including, but not limited to, the Student’s learning styles, medical conditions, behavioral issues, and emotional needs. I understand that, to the extent I have not disclosed the information already, once the Student is admitted to the School, I must promptly disclose the complete social, disciplinary, medical, and academic history of the Student, and must notify the School of any changes throughout the Student’s enrollment. School health care professionals strive to respect student privacy, however, there are times when information may need to be shared with parents, select faculty, and school administrators. Therefore, as a condition of the Student’s enrollment, I consent to the release of any of the Student’s health-related or behavioral information, including information relating to drug and alcohol treatment and testing and mental health records, to School faculty and administrators and their agents who have a need to know, when the School has determined such release is in the best interests of the Student and/or other members of the School community.

I attest that all of the information provided to the School is accurate and complete to the best of my knowledge. I understand that any false, inaccurate, incomplete, or misleading statements may be grounds for dismissal of the Student.

The School’s ability to portray its program accurately and vibrantly depends on families’ support of the School’s use of images of students and students’ work. Therefore, I authorize the School, its successors and assigns, and those acting within its permission and upon its authority, to use the Student’s name, photographic image, audio recordings of the Student’s voice, video recordings of the Student, and likeness, in written or in electronic format, and reproductions of the Student’s work, including media from a remote learning context (collectively referred to as “Student Media Information”) in the School’s publications, marketing and promotional materials, website, social media accounts, press releases, and/or advertising media. I shall not be entitled to receive any compensation for such use, and I hereby release the School, its successors and assigns, and those acting within its permission and upon its authority, from any liability, responsibility, or claim that may arise by reason of any exercise of the authority granted above. I acknowledge and understand that this provision survives the termination of this Contract. If I do not consent to such use, I agree to notify the Mount Alvernia High School’s Administrative Office in writing prior to August 15, 2023. While the School strives to abide by parent/guardian wishes, it does not guarantee incidental uses of a student’s name or image will never occur.

I acknowledge that I am not authorized to use the School’s name (“Mt. Alvernia High School, Inc.”), any likeness of or reference to the School’s name (e.g., “Mt. Alvernia,” “MAHS,” and the like), or crest or logo in any way, including to describe any event, outing, club, sports team, group, or other activity (“Group”) that the Student or I may organize, lead, or participate in, without the express written permission of the Head of School (or designee). If the Student or I participate in any activity that uses the School’s name or a name like or resembling the School’s name or logo that is parent-organized or led by others, including current and former School faculty, I understand that the Group is not sponsored or endorsed by the School unless the Head of School (or designee) issues written notice that the Group has been recognized by the School. Any questions about whether a Group is sponsored by the School should be directed to the Head of School (or designee). I acknowledge and understand that this provision survives the termination of this Contract.

I understand and agree that the duties and obligations of the School under this Contract may be modified or suspended immediately and without notice because of force majeure causes beyond the School’s reasonable control and occurring without its fault or negligence including, but not limited to, acts of God, fire, wars, governmental action, terrorism, epidemic, pandemic, weather, other threats to the safety of students, national emergencies, or any other event beyond the School’s control. If such an event occurs, I acknowledge and agree that my obligations under this Contract, including my financial obligations, will continue and the School’s duties and obligations may be modified, suspended, or postponed until such time as the School, in its sole discretion, may safely resume operations. I acknowledge and agree that the sole remedy for a force majeure event is future service delivery and not a financial refund. The School may, at its option, and in its sole discretion alter the academic year schedule or provide alternate means of instruction, including, but not limited to, distance or remote learning.

This Contract, and all rights and obligations provided for herein, shall be governed by the laws of the Commonwealth of Massachusetts without regard to conflict of law principles. Any dispute arising out of this Contract or otherwise between the School and me must be heard exclusively in the state or federal courts located in Massachusetts. If any part of this Contract is found to be unenforceable or illegal, the remainder of this Contract shall still be valid and enforceable to the fullest extent permitted by law. This Contract is the entire agreement of the parties relating to the Student’s enrollment in the School, and I acknowledge that I am not relying on any other oral or written agreements. This Contract may not be amended or modified except in a written document signed by all parties that expressly acknowledges such amendment or modification. Multiple copies of this Contract may be signed, all of which shall constitute one and the same agreement. I understand that certain provisions of this Contract survive termination of the Contract.

Absent legal documentation to the contrary, this Contract must be signed by all parent(s) and legal guardian(s), as well as any other individuals who are financially responsible for the Student’s enrollment in the School, but one signature on the Student’s behalf is sufficient to create a binding contract.

By signing below, I acknowledge that I have read this Contract and understand and accept all of its terms and conditions.

In Memory Of Sister Damon

We are saddened to share the news of the passing of Sister Mary Damon Nolan, mfic.

Sister Damon was the first principal of Mount Alvernia High School when the school moved to 790 Centre Street in 1972. She served as the school’s principal until 1979. Sister Damon followed her passion for education and moved to Bolivia to teach. In 1993, she founded UAC-Carmen Pampa, a satellite campus of Catholic University to serve the poor in a rural Bolivian village. Ten years later, in 2003, the United Nations recognized the UAC-Carmen Pampa as an institution with “best practices in poverty eradication.”

In more recent years, Sister Damon returned to 790 Centre Street. Always a Mustang fan, she could often be spotted at basketball games. The 2019 Varsity Basketball team named her an honorary member. In 2020 she was named a Mount Alvernia High School 7 C’s Woman.

Sister Damon’s wake will be held in the Chapel of Mount Alvernia High School on Thursday, June 10th from 4-8pm with a wake service at 6:30pm. Her funeral will be held on Friday, June 11th at 10am.

The legacy of Sister Damon will continue to live in our hearts and be forever felt at 790 Centre Street.
